The undersigned Client has agreed to receive personal training services (“Services”) from Getting Genki Fitness, LLC (“Trainer”). The furnishing of the Services by Trainer to Client are contingent upon the terms of this Form. 1. Client agrees that Client is voluntarily participating in the Services and engages with Trainer for the Services at Client’s own risk, and Client therefore assumes all risk of any and all injury and/or damage to Client, Client’s property and/or to others. This includes, to the extent permitted by law, any injuries or damages arising out of the negligence of Trainer, whether active or passive. 2. Client agrees on behalf of Client and all of Client’s representatives, heirs, executors, administrators, agents, and assigns, to release and discharge Trainer and Trainer’s affiliates, related entities, employees, agents, representatives, successors, and assigns from any and all claims or causes of action, known or unknown, arising out of the Services and/or all of Trainer’s actions related to the Services. 3. Client hereby agrees to indemnify and hold harmless Trainer and Trainer’s affiliates, related entities, employees, agents, representatives, successors, and assigns from any loss, liability, damage, or cost related to the Services and/or all of Trainer’s actions related to the Services. 4. Client expressly agrees that the foregoing clauses are intended to be as broad and inclusive as permitted by the law and that if any portion thereof is held invalid, it is agreed that the balance continue in full legal force and effect. Client is aware and agrees that by executing this Form, Client is giving up Client’s right to bring a legal action or assert a claim against Trainer. Client further acknowledges that Client has been advised to submit to a medical examination to ensure Client’s own responsibility for Client’s physical fitness and capability to perform fitness related activities. Client has read, understands and voluntarily signs this form with full knowledge of the terms stated herein and with full understanding that client is giving up rights and claims.
